Privacy and your data

Children’s Services at Buckinghamshire Council use your personal information to tell the Department for Education if you are learning or working, and to offer you help if you need it.

What information do we hold about you

  • Name, date of birth and contact details. This is so we know who you are and can get in touch with you.
  • Sex and ethnicity. These help us treat you fairly.
  • Characteristics such as if you have a special education need or disability, or are working with Youth Justice. This is so we can give you the right information.
  • Education, training and employment you have had or plan to attend. So we know if you are learning or working.
  • Contact we have had with you, your parents or carers or other professionals working with you. This is so we can help you move into work or learning.

Why we need your information

We need information about you to find out if you are in employment, education or training and report this to the Department for Education. With this information, we can offer you help to find education or training if you need it.

How the law allows us to process your information

The Education Act 1996 and the Education and Skills Act 2008 say we must process information about young people and encourage them to continue learning.

If you give us your permission on a 'What Next' form, we may tell your previous school where you are working or studying in year 12. You can change your mind about this at any time by contacting [email protected].

Who we will share information with

We may share your information with:

  • The Department for Education
  • Other council services you are working with
  • Your home local authority if you move to another area, or you learn in Buckinghamshire but live somewhere else.
  • Your previous school, if you have given us your permission to tell them where you are working or studying.

In exceptional circumstances, we may share your personal information without your agreement. For example, if there is a risk of serious harm to you or someone else, or there is a legal reason to do so.

How we look after your information

We will hold your information securely and only retain it for as long as necessary. When it is no longer needed, it will be destroyed.

If you have any concerns about our use of your personal information, you can make a complaint to the Data Protection Officer. You can also complain to the Information Commissioner's Office if you are still unhappy after this.
