Personal budget policy for children and young people aged 0 to 25 with special educational needs and their families

Introduction

The Children and Families Act 2014 and SEN Regulations 2014 came into force on 1 September 2014. The SEN Code of Practice (CoP) introduced new legislation in respect of personal budgets.

This document explains:

  • who can request a personal budget
  • the associated funding
  • how to manage a personal budget
  • how to change a personal budget

In this document 'child or young person' is used to refer to the subject of the EHCP.

'Parent' is used to refer to the person with legal authority to act on behalf of the child before they reach the end of compulsory schooling or when the child or young person lacks mental capacity to act on his or her own behalf.

Where the parent or young person lacks capacity, references to ‘parent’ and ‘young person’ are used to refer to a representative of the parent or young person.
